Conditions of participation for the LOYALTY CARD FOR MEN scheme by HIRMER big & tall
1. Participation in the HIRMER LOYALTY CARD FOR MEN scheme
The HIRMER big & tall LOYALTY CARD FOR MEN scheme (hereafter referred to as “LCMS”) is run by HIRMER big & tall GmbH & Co. KG, Kaufingerstr. 28, 80331 Munich, Register Court Munich District Court, HRA 71004 (“HIRMER big & tall”) under these conditions of participation. The scheme is open to anyone over the age of 18 . Participation is free of charge. If you have applied for a LOYALTY CARD FOR MEN (hereafter referred to as “LCM”), you can benefit from the advantages of the LOYALTY CARD FOR MEN scheme after confirmation of your registration by e-mail or when you receive the final LCM. Sales that are collected via a preliminary LCM (only possible for purchases in the stationary trade stores of HIRMER big & tall) will be credited to your final LCM after confirmation of your registration by e-mail or when you receive the final LCM. For registration in the HIRMER big & tall app (hereafter referred to as “app”) or in the HIRMER big & tall online shop, sales will be credited to you upon confirmation of your registration by e-mail. The LCM remains the property of HIRMER big & tall. The card is not transferable.
2. Earning and redeeming benefits
As a participant in the LCMS, you will receive advantages (e.g. discount vouchers, invitations to customer breakfasts, purchase vouchers when registering for the LCMS in a physical store). Using these advantages may be associated with further conditions (minimum purchase value, redemption periods etc.). Vouchers obtained within the context of the LCMS can only be redeemed upon e-mail confirmation of the registration or with the final LCM, not with the preliminary LCM. Vouchers are not transferable and no cash payments will be made. A credit from a welcome voucher that is credited to the customer account upon confirmation of the registration for the LCMS expires if it is not redeemed within 6 months from being credited. Other vouchers obtained within the context of the LCMS expire within their respective specified time frames, but at the latest after 12 months.
3. Benefit status
Sales made by presenting the LCM count toward achieving a particular benefit status. For this status, sales in the online shop of HIRMER big & tall Online GmbH - Kaufingerstr. 28, 80331 Munich, as well as HIRMER big & tall Austria GmbH & Co. KG – Mariahilfer Straße 1a / Rahlgasse, 1060 Vienna, are also taken into account. Sales are determined by the receipt total including delivery and alteration costs minus any discounts, other rewards and supplements. Sales from drinks or other meals, e.g. in the TAGESBAR in the HIRMER Stammhaus in Munich, as well as the purchase of gift vouchers, are excluded. For purchases made in physical stores, the sale volume and purchase data will be posted to the customer account and will count towards the benefit status if the customer has provided his 8-digit customer number. In the online shop, sales are stored and allocated automatically if the participant has registered his LCM separately in the customer account (quoting the customer number and confirmation of the registration by e-mail required) and the participant is logged into his personal account when submitting the order. Sales that are posted for a benefit status are reduced if the purchase for which they were earned is cancelled in full or in part (e.g. right of withdrawal for online purchases or other returns). Sales made using the LCM as well as the relevant purchase data can be viewed online in the customer account or in the app at any time after registering accordingly.
LCM cardholders will first be assigned entry-level status. From an annual sales volume of €1,500, you will achieve the next status level, associated with certain benefits that may be limited in duration and may change. Only sales volumes (receipt total including delivery and alteration costs minus any discounts, other rewards and supplements) that have been collected with the companies named above in the last 365 days are taken into account for the calculation of the status (not sales volumes collected with other companies of the HIRMER Group). Sales volumes collected in the online shop are only taken into consideration for determining the status 30 days after being credited due to possible withdrawals / returns. As soon as a participant has reached a certain status, this status is retained for 1 year (with continuing participation in the LCMS). The number of status levels and the conditions for achieving them may be changed with future effect (see Clause 5). You can view the current benefits at any time, either by requesting them, or in the online customer account or the app.
You can use the Loyalty Card for Men anywhere this is listed as an accepted customer card, even with other companies in the HIRMER Group. For instance, this includes the stores and online shops of HIRMER GmbH & Co. KG – Kaufingerstr. 28, 80331 Munich, Eckerle GmbH & Co. KG – Kaufingerstr. 28, 80331 Munich and in Travel Charme hotels and resorts, which also belong to the HIRMER Group as part of Travel Charme Hotel GmbH & Co. KG, Wittestr. 30 L, 13509 Berlin. However, these sales will not count towards your status. You can view your transactions if you are logged in to your customer account with HIRMER big & tall (currently available for purchase in the fashion shops of companies within the HIRMER Group). You hereby grant your consent to the use of the LCM with other companies and additional commercial uses (see Clause 7).
4. Cancellation, end of the LOYALTY CARD FOR MEN scheme, lost cards
The participant can end participation in the HIRMER LOYALTY CARD FOR MEN scheme at any time and without a period of notice by notifying [email protected] or HIRMER big & tall. In this case, points that have not been redeemed, status benefits and customer accounts credits resulting from advertising campaigns for the LCMS are forfeited without compensation. HIRMER big & tall can cancel individual memberships at any time, provided a two-week notice period is observed. The right to extraordinary termination for good cause without observation of a notice period remains unaffected at any time. Participation in the LCMS automatically ends 2 years after your last purchase from a fashion shop in the HIRMER Group using the LCM without requiring special cancellation (no later than 31.03.2021). In case of termination, your customer card will be deactivated. Your customer account will continue to exist unless you wish for your data to be deleted. HIRMER big & tall reserves the right to end the LCMS, under observation of a reasonable notice period, at any time without stating the reason and / or to replace it with another scheme. If an LCM is lost or damaged, the participant shall inform HIRMER big & tall so that the card can be blocked and misuse by third parties, in particular the use of credits and benefits, can be avoided. HIRMER big & tall shall not be liable for any misuse unless HIRMER big & tall or companies of the HIRMER Group are responsible for same.
5. Changes to the conditions of participation
HIRMER big & tall reserves the right to change the General Conditions of Participation at any time with future effect, especially for improving handling, making changes to customer benefits or for preventing misuse. The participant will receive notification of the changes in text form. If the participant does not object in text form to HIRMER big & tall within a period of one month, the changes will be deemed to be accepted. The changes will also be deemed to be accepted if the participant generates new sales by using his customer card after receipt of the changed conditions. This will be separately indicated in the change notification to the participant. In the case of an objection, participation in the LCMS is ended and the consequences of termination by the participant shall apply (see Clause 4.).
6. Collection and use of data
As a controller for data processing, HIRMER big & tall takes the protection of your data seriously. We have implemented appropriate technical and organisational measures to ensure the security of your data and its processing according to the statutory requirements. The personal data obtained as part of the LCMS is collected, processed and used subject to the relevant valid statutory data protection regulations for the purpose of implementing the LCMS and associated services, warranties and guarantees, as well as to fulfil your other requests (the legal basis is Art. 6 (1)(b) General Data Protection Regulation, GDPR). Additionally, we use your data on the basis of the consent you gave us for the purposes of promotional offers and market research for companies in the HIRMER Group (Art. 6 (1)(a) GDPR). Within the framework of our interest in economical and efficient customer care, and to prevent unnecessary promotional offers (for instance preventing duplicate invitations to events), when conducting advertising we will compare your address data and associated promotional initiatives with the corresponding data concerning you held by other companies within the HIRMER Group (Art. 6 (1)(f) GDPR).
A telephone number will only be used in case of queries in relation to your application to participate in the LCMS (no promotional offers by telephone). You will only receive promotional offers by e-mail as well as notifications from the app if you have separately agreed to this. You can object to receiving promotional offers by mail at any time with effect for the future (see also "8. Your Rights" below). Data will only be transferred to third parties if you given your consent for this purpose or if this is necessary in order to redeem or grant benefits, for instance to check your authorisation. Your data will not be transferred to third countries (outside the EU or EEA). It will be used as long as it is necessary for the intended purposes, or for the use of data based on legitimate interests, until that interest no longer applies or until an objection is made, or until consent is withdrawn where relevant.
7. Your consent to the collection and use of data
You agree that the data listed below can be collected and processed by us for the purposes of market research and, based on data analysis, for the selection, adaption and transmission of promotional offers that are tailored to your interests within the framework of the LCMS by posts or displays during visits to our websites, or when using the app (no promotional offers by e-mail if this has not been separately agreed, no push notifications, and no promotional phone calls).
When using the LCM with another company in the HIRMER Group, you hereby grant your consent that the data concerning your transactions with those companies may be transferred to us, stored in your customer account and made available for you to view online (after registration). You also consent that the following data may be made accessible to companies within the HIRMER Group for the above purposes of promotional offers and market research, and may be used by these companies.
We use the following data: Personal data provided by you for participation in the LCMS; data concerning your purchases and other transactions in physical stores or online or via app (date, place, object, value), in relation to the time, type and scope of vouchers used and participation in campaigns, such as competitions, events, the use of customer card benefits, time and type of response to promotional material sent to you (use of offers in addressed promotional offers and newsletter information, clicks on links in this material, cancellations), as well as data relating to your online shop visits or app usage (times, pages, devices, browsers used, use of links, buttons or other campaign elements and offers followed and purchases not completed). We also use online cookies on web pages or in the app to collect this data. You can find further details in the privacy notices on the websites of the companies of the HIRMER Group or in the privacy notice of the app.
Our further use of data: The above-mentioned data are used in the planning of new LCM activities and for the creation of other offers and promotional offers in order to select services to suit your personal interests. Within the framework of use for promotional offers, you will receive information on initiatives and other offers from fashion and hotel companies within the HIRMER Group by mail or displayed to you when visit our websites or use the app.
If you have also given your consent, we will also inform you on that basis via e-mail and/or notification function of the app on the device the app is used on.
8. Your rights
The participant can object to the promotional use of their data with effect for the future at any time. This also applies for the use of data in the context of profiling for the purposes of direct marketing. You may withdraw consent to the commercial use of data, e.g. the use of your e-mail address for the e-mail newsletter or the receipt of promotional notifications on your device through the app, at any time with future effect. HIRMER big & tall or companies of the HIRMER Group will not charge you for this.
You also have the right to information, rectification, erasure, restriction of processing, data portability and other rights of objection and complaint. Objecting to promotional mailings or withdrawal of associated consent (mail or email or push notifications) does not affect your participation in the LCMS. Objection or withdrawal will not affect previous initiatives that have been carried out and other usage of data involving your participation and the consent provided for this purpose. If you would like to object to the use of your data for promotional purposes as a whole, or request complete erasure of data, this will be considered a termination of your participation in the LCMS.
